General terms and conditions of sale

The present General Terms and Conditions of Sale are concluded, on the one hand, by Fabian Pierre, founder of the natural person entity under the commercial name of Rhumanticregistered in the Brussels Trade and Companies Register under number 0737.744.485, hereinafter referred to as "the Company".Rhumantic"and on the other hand, any natural or legal person wishing to purchase products marketed by Rhumantichereinafter referred to as "the Customer".

Introduction

The present General Terms and Conditions of Sale define the contractual relationship between Rhumanticand the Customer, as well as the conditions applicable to any purchase. At the time of ordering, the Customer acknowledges having read them and accepts them unreservedly. Acceptance of these conditions can only be full and complete. Any membership with reservations is considered null and void.

They apply to both private individuals and professionals placing orders, it being specified that certain provisions such as the right of withdrawal do not apply to professionals.

These conditions of sale prevail over any other written General or Special Conditions, which would not have been expressly accepted by Rhumantic.

Rhumantic reserves the right to modify its Terms and Conditions of Sale at any time. In this case, the applicable conditions will be those in force at the date of the order by the Customer.

1- Orders

To place an order for a product from the site www.Rhumantic.beThe Customer is not required to create a customer account. The Customer may place an order without prior identification, but will still be obliged to fill out a form, in order to indicate the information necessary for the order and delivery, namely: name, first name, e-mail address, postal address and telephone number. Additional information may be requested at a later date to ensure the quality and safety of the delivery.

The Customer is responsible for the information transmitted with the order and will therefore assume the consequences in the event of erroneous information having made the delivery of the product(s) impossible. Undelivered products will then be returned to Rhumantic. The forwarding expenses are the exclusive responsibility of the Customer.

By clicking on the "Confirm Order" button, the Customer definitively validates his order and manifests his commitment to pay the amount of his order in full, and his acceptance of the General Terms and Conditions of Sale. A summary of the order is then communicated to the Customer on the screen as well as by e-mail. The electronic registers kept by Rhumanticconstitute proof of the nature, content and date of the order.

The sale from the site www.Rhumantic.be is only deemed to have been concluded as of receipt of payment of the order amount by Rhumantic. Rhumantic reserves the right to cancel any order from a Client with whom there is a dispute over payment of a previous order.

2- Availability of products

The products are deliverable within the limits of available stocks, and shipped according to the order of arrival of orders. Upon receipt of the order, Rhumanticcheck the availability of the product(s) ordered. 

In the event of an order for a product that is out of stock, Rhumantic will inform the Customer by e-mail as soon as possible, and may offer an equivalent product (in price and/or value). The Customer is free to accept or not the offer, and is solely responsible for the final choice. The advice provided by Rhumantic will not be subject to any claims. 

In the event of a cancelled sale, and the Customer will be refunded the amount paid by him within 14 days of the date on which Rhumanticthe Customer was informed of the unavailability of the product.

3- Product prices

The prices of each product are displayed on the site in euros, including all taxes and excluding shipping costs. They can be revised at any time and without notice. Items are invoiced in euros on the basis of the prices indicated on the site at the time of the order.

The final price of the order includes the price of the products with VAT as well as the shipping costs.

Payment must be made in full as soon as the order is entered on the site.

The tariff conditions presented on the site are only valid for shipments to Belgium.

4- Payment

The price invoiced to the Customer is the price indicated on the site at the time of the order, and mentioned on the order confirmation.

The sale is considered effective only upon receipt of payment in full of the amount of the order by Rhumantic. 

In case of refused payment, the order is automatically cancelled. Rhumanticmay also cancel any order from a Customer with whom there is a dispute over payment.

A detailed invoice will be sent to the Customer in his package. The indication of the amount of the VAT gives, in certain cases, the possibility to the professionals to recover it.

5- Method of payment

Payments are made in euros, net, and without discount.
The Customer pays for his order by credit card on the seller's website. The payment is made through an independent and secure payment solution. The banking information provided at the time of payment is encrypted and no third party can read it.

The credit card used to pay for the order will be debited immediately at the time of ordering. In case of refused payment, the Customer must contact his bank. 

Rhumantic is not responsible for any malfunction at the time of payment.

6- Shipping and delivery

The products are delivered exclusively to Belgian physical addresses. 

Deliveries can be made either to the relay point chosen by the Customer, or to the Customer's home. Rhumantic has chosen the GLS offer for these two delivery methods. This offer has a parcel number that enables you to track the delivery of the parcel.

Shipping costs are at the Customer's expense. They are indicated at the time of the order, and are deemed to be accepted by the Customer irrevocably. The price of delivery is invoiced in addition to the price of the products, and is fixed. Home delivery will be invoiced to the Customer 4.95 € VAT included.

The products are delivered to the address indicated by the Customer. The Customer is responsible in case of erroneous information, and will have to pay all possible forwarding expenses.

The delivery period begins on the date of receipt of the order. If the item ordered is available in stock, the delivery time is approximately 10 (ten) days. Delivery within the time limits can only take place if the Customer is up to date with his obligations towards Rhumantic.

Unless otherwise stipulated in the contract, delivery times are only given as an indication and any delay cannot give rise to the cancellation of the order or to any compensation whatsoever.

Any case of force majeure or fortuitous event suspends the obligations of the seller and exonerates him from any responsibility in case of late delivery or impossibility of delivery. In such cases, the seller reserves the right to cancel the contract, without being liable for damages.

The Customer is required to ensure the integrity of his order and all the items that make it up upon receipt of the package and in the presence of the person making the delivery in order to issue a reservation if necessary.

In the event that the Customer has any doubt about the state of the contents of the order, he is obliged to refuse the goods on receipt of the order. Any refused product must be handed over to the carrier in its entirety and in its original packaging. The Customer must inform Rhumanticby e-mail within 7 days following the delivery. 

Rhumantic undertakes to take particular care in the packaging of each of its orders and ensures that its products are securely packaged.

7- Warranty

Any product sold benefits from the legal provisions of the guarantee of hidden defects and the legal guarantee of conformity. The guarantee is applicable on presentation of the purchase invoice.

Defects and damage caused by natural wear and tear, by improper use, by modifications not foreseen or specified by Rhumanticare excluded from the warranty.

For all warranty claims, the product must be sent to Rhumantic- Avenue Le marinel 160 in 1040 Etterbeek. The package must be accompanied by a copy of the invoice and an explanatory letter specifying the problem.

In any case, the Customer must keep the product in such a way that it remains suitable for a potential new marketing - the original packaging essential to the resale must be kept -, until the acceptance of return formulated by an email sent by Rhumantic.

In the event of a guarantee, insofar as the product is recognised as having a hidden defect or a defect in conformity and the guarantee is activated, the return costs incurred by the Customer for the guarantee claim as well as the costs of reshipping a new product shall be borne by Rhumantic.

On the other hand, insofar as the guarantee is not recognised, the product is returned at the Customer's expense. The costs of returning the product for the warranty claim are also borne by the Customer.

8- Right of withdrawal

In accordance with the law, the Customer has the right to notify the seller that he renounces his purchase, without penalty and without giving any reason, within 14 calendar days from the day following the day of delivery of the product. If the aforementioned period expires on a Saturday, or on a Sunday, or on a holiday or public holiday, it shall be extended until the first following working day. In the case of an order relating to several products delivered separately, the delivery of which is staggered over a defined period, the period shall run from receipt of the last product.

The burden of proof for the exercise of the right of withdrawal lies with the Customer.

Within this period, the Customer must notify his intention to withdraw by e-mail or via the withdrawal form attached to these General Terms and Conditions of Sale, and return, at his expense and risk, the product delivered to the seller's address, Avenue le Marinel 160 - 1040 Etterbeek.

The products must be returned in their original packaging, undamaged, accompanied by all their accessories, as well as the original invoice.

Products returned in this way must not have been unpacked, unsealed or used in any way.

Incomplete, damaged or soiled goods will not be taken back.

The value of the returned products, as shown on the invoice, will be refunded to the Customer, less the initial shipping costs of the delivery, within 14 days of receipt by the seller of the products in their condition.

This right of renunciation does not belong to the Professional Client.

9- Confidentiality

All the provisions relating to the privacy policy can be consulted in our legal notice, which can be accessed at any time from the site. www.Rhumantic.be .

10- Protection of minors and pregnant women

In accordance with the laws in force in Belgium, the sale of alcohol to minors under the age of eighteen is prohibited. The Customer undertakes to be at least 18 years of age when placing an order on the seller's website.

By placing an order on our site and ticking the appropriate box, you agree to be at least of legal age on the date of the order.

Alcohol abuse is dangerous for your health. Enjoy in moderation.

The consumption of alcoholic beverages during pregnancy can have serious consequences on the health of the child.

11- litigation

Our contractual conditions and their execution are subject to Belgian law. 

All disputes shall be subject to the exclusive jurisdiction of the courts within the jurisdiction of our registered office. Information on alternative dispute resolution methods can be obtained via the link http://ec.europa.eu/odr but we reserve the right to submit any dispute exclusively to the courts.
